Article 1 – Definitions In these terms and conditions, the following definitions apply:

  • Cooling-off Period: The period within which the consumer can exercise the right to cancel the contract;
  • Consumer: A natural person who does not act in the course of a profession or business and who enters into a distance contract with the entrepreneur;
  • Ongoing Contract: A distance contract concerning a series of products or services, with obligations distributed over time;
  • Right of Withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period;
  • Entrepreneur: The natural or legal person offering products or services to consumers remotely;
  • Distance Contract: A contract concluded between the entrepreneur and the consumer using remote communication techniques;
  • CESOP: The EU’s Central Electronic System of Information on Payments, introduced to monitor payment service providers.

Article 3 – Applicability These terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded. Before finalizing the agreement, the terms are made available electronically or otherwise.

Article 4 – The Offer

  • Offers are not binding. The entrepreneur reserves the right to modify the offers.
  • The offer clearly specifies the total costs, including shipping fees, customs duties, and any other additional costs charged by postal or courier services.

Article 5 – The Contract The contract is concluded once the consumer accepts the offer and agrees to the specified terms. The entrepreneur will immediately confirm the acceptance via email.

Article 6 – Right of Withdrawal

  • Consumers have the right to withdraw from the contract within 14 days of receiving the product without providing a reason.
  • Return shipping costs are the consumer's responsibility when exercising the right of withdrawal.

Article 7 – Costs in Case of Withdrawal The entrepreneur will refund payments within 14 days of receiving the return, provided the product is returned in its original condition.

Article 8 – Customs and VAT Regulations

  • The customer is solely responsible for fulfilling all legal obligations related to the importation of goods into the delivery country, including but not limited to customs duties, taxes, and customs clearance fees.
  • The entrepreneur does not act as the official importer for products shipped to the customer.
  • The customer is responsible for ensuring that the importation and use of the purchased products comply with local laws and regulations.
  • All additional costs incurred during customs clearance, including administrative fees imposed by postal or courier services, are the customer’s responsibility.
  • The entrepreneur provides necessary documentation for shipping but does not guarantee that the goods comply with local import regulations. Customers are advised to check the import requirements before placing an order.

Article 9 – CESOP Compliance From 2024, payment service providers will register transaction data in the CESOP system (Central Electronic System of Information on Payments) as required by EU regulations. The entrepreneur complies with these regulations, which may affect the monitoring and reporting of payments.

Article 10 – Compliance and Warranty

  • The entrepreneur guarantees that the products meet the agreement and legal requirements.
  • Complaints regarding defects must be reported in writing within 14 days.
  • Products must be returned in their original packaging and in the same condition.

Article 11 – Delivery

  • Orders will be delivered within 30 days unless otherwise agreed.
  • In case of delays, the entrepreneur will inform the consumer within 14 days of the order date.
  • Orders are shipped such that the customer is the recipient and is responsible for any process related to importation.
  • The entrepreneur ensures that products are shipped in accordance with international shipping regulations but does not take responsibility for delays or issues during customs clearance.
  • Failure by the customer to comply with importation obligations does not constitute grounds for canceling or refunding the order.

Article 12 – Complaint Resolution

  • Complaints must be submitted in writing within 7 days of discovering the issue.
  • The entrepreneur will respond to complaints within 14 days. If more time is needed to resolve the issue, the entrepreneur will provide an indication of the timeline.

Article 13 – Disputes These terms and conditions are governed by Dutch law. Disputes should preferably be resolved amicably. If necessary, disputes will be submitted to the competent court in the Netherlands.

Article 14 – Return of Lingerie For hygiene and sanitary reasons, it is not possible to return or exchange lingerie once the purchase is completed. Once payment is made, the sale is final, and the product can no longer be returned or exchanged.

If the received lingerie is defective or damaged, please contact us within 14 days of receipt. We will inspect the product and, if necessary, provide an appropriate solution.
